В случае выявления несоответствия документации, перечисленной в пункте G.9.7. выше, требованиям Концессионного Согласия, Концедент в течение 5 (пяти) рабочих дней с даты ее получения от Концессионера направляет ее обратно Концессионеру с указанием оснований, по которым она не может быть принята к оплате.Концессионер вносит необходимые исправления в данную документацию в соответствии с требованиями Концедента и повторно напрвляет ее Концеденту, после чего применяется порядок, указанный в пунктах G.9.6-G.9.7 выше.В случае несогласия Концессионера с требованиями (замечаниями) Концедента считается, что между Сторонами возник спор, подлежащий урегулированию в соответствии с Процедурой Разрешения Споров.In case of detection of non-compliance of the documentation, listed in paragraph G.9.7.above,the requirements of the Concession Agreement,the Grantor sends it back to the Concessionaire within 5 working days from the date of its receipt by the Concessionaire with indicating evidence или grounds on which it can not be accepted for payment.Concessionaire shall make the necessary corrections to this documentation in accordance with the Grantor's requirements and re-directs или re-sends it to the Grantor after that order is used indicated in paragraphs G.9.6.-G.9.7. above. In case of disagreement by the Concessionaire with the Grantor's requirements (remarks) it is believed that there was a dispute between the Parties, to be settled in accordance with the dispute resolution procedure. |
